Senior Advocate Tika Ram Bhattarai Objects to Parliamentary Committee Review of Judicial Decisions

Kathmandu. Senior advocate Tika Ram Bhattarai has objected to the proposal to form a committee in parliament to study and evaluate judgments made by judges. He stated that the provision for political parties or parliament to review whether judgments made by the court in interpreting the constitution and laws are correct or incorrect would be against judicial independence.

Bhattarai recalled through social media that a formal proposal to place the court under a parliamentary committee had also come during the first term of the Constituent Assembly. According to him, attempts to place the judiciary under the executive or legislature and the tendency to pressure judges with impeachment to stop unconstitutional actions of the government have been recurring since the past.
