काठमाडौँ । नेपाल यातायात व्यवसायी राष्ट्रिय महासंघको पोखरामा सम्पन्न महाधिवेशन कानून र विधानविपरीत भएको भन्दै गृह मन्त्रालयमा उजुरी परेको छ । गएको बैशाख २७ देखि २९ सम्म भएको महासंघको सातौं राष्ट्रिय महाधिवेशन भएको थियो ।
आफूले दाबी विरोध गर्दा पनि विधानको व्यवस्थाविपरीत पदाधिकारी निर्वाचित भएको भन्दै उपाध्यक्षका प्रत्यासी रामशशी पाण्डे, कोषाध्यक्षका प्रत्यासी राजेशकुमार श्रेष्ठ, वर्गीय संयोजक (माइक्रो) का प्रत्यासी केदार सापकोटालगायतले निर्वाचन परिणाम बदर गर्न, पदस्थापना रोक्न र निर्वाचन समितिका संयोजक कृष्णप्रसाद ज्ञवाली समेतलाई कारबाहीको माग गर्दै उजुरी गृहमन्त्रालयदेखि विभिन्न निकायमा उजुरी दिएका हुन् । राष्ट्रिय निर्देशक ऐन २०१८ अन्तर्गत दर्ता भएको संस्थाले गृह मन्त्रालयमा उजुरी दिएको हो ।
उपाध्यक्षका उम्मेदवार चन्द्रा ओझा, कोषाध्यक्षका उम्मेदवार राजेन्द्र आचार्य र सहकोषाध्यक्षका उम्मेदवार शोभाकर पौडेलको योग्यता नपुगे पनि उम्मेदवारी कायम गराएको उनीहरुले बताए ।
फर्जी व्यवसायीका आधारमा निर्वाचन गरिएको र आफूले दाबी विरोध गर्दा पनि निर्वाचन समितिबाट सुनुवाइ नभएपछि गृह मन्त्रालयमा उजुरी दिएको यातायात व्यवसायी राजेशकुमार श्रेष्ठले जानकारी दिए ।
उनका अनुसार, महासंघले जारी गरेको सूचनाबमोजिम मताधिकार भएका १ हजार ४ सय ७३ जनाको नाम वैशाख २७ गते निर्वाचन समितिले मतदाता सूची प्रकाशित गर्दा पनि सोही संख्या रहेकोमा वैशाख २९ गते २ सय ६ जनाको नाम थप गरी वैशाख ३० गते निर्वाचन गराएको थियो ।
विधानको दफा २५ (क) बमोजिम केन्द्रीय सदस्यमा टंकप्रसाद बस्याल, गणेश श्रेष्ठ र ज्ञानबहादुर बस्नेत गरी तीन जना मनोनीत भइसकेको अवस्थामा श्री श्रेष्ठ, अरुण श्रेष्ठ, देवेन श्रेष्ठ, राजेन्द्र आचार्य तथा मालवाहकतर्फ विज्ञ सल्लाहकारका रूपमा गोकर्णप्रसाद पराजुलीलाई अन्तिम समयमा नेतृत्वकै लागि विधानविपरीत केन्द्रीय सदस्यमा मनोनीत गरिएको उनीहरूको आरोप छ। उनीहरूका अनुसार यसरी रातारात विधानविपरीत मनोनीत गरिएका व्यक्तिहरूलाई महासंघको पदाधिकारीसमेत बनाइएको छ।
महासचिवका अर्का उम्मेदवार रमेशकुमार खड्काको उम्मेदवारी भने योग्यता नपुगेको भन्दै निर्वाचन समितिले माइकिङ गरी फिर्ता गराएको थियो । योग्यताको हकमा फरक–फरक मापदण्ड लागू भएको उनीहरूको आरोप छ ।
उनीहरुले निर्वाचन बदर गर्न १ हजार ४ सय ७३ जनाको मतदाता सूचीसमेत छानबिन गरी कायम गर्न र निर्वाचित भएको मानिएका व्यक्तिहरुको पदस्थापना कार्यक्रमसमेत रोक्का गर्न र विधानविपरीत मनोनीत गरिएका केन्द्रीय कार्यकारिणी समितिको बैठकका निर्णय कपीहरु महासंघको कार्यालयबाट झिकाई छानबिन गर्न माग गरेका छन् ।
विधानविपरीत केन्द्रीय सदस्य बनाएर कोषाध्यक्षमा राजेन्द्र आचार्यलाई जस्केलाबाट ल्याएको आरोप महासंघका पूर्वअध्यक्ष बिजयबहादुर स्वाँरमाथि लागेको छ ।
उनकै डिजाइनमा महासंघको बिधान अनुसार ३ जना केन्द्रीय सदस्य मनोनीत गर्नुपर्नेमा ८ जना गरिएको र राजेन्द्र आचार्यहरुसँग प्रभावमा परी उनलाई कोषाध्यक्ष बनाएको आरोप छ । स्वाँर नेपाली कांग्रेसका केन्द्रीय सदस्यसमेत हुन् ।
महासंघको निर्वाचन विधानविपरीत भएकाले निर्वाचन परिणाम बदर गर्न, पदस्थापना कार्यक्रम रोक्न र निर्वाचन समितिका संयोजकलाई कारबाही गर्न माग गर्दै उच्च अदालत पाटनमा मुद्दा पनि दर्ता भएको छ । जसको सुुनुवाइ जेठ २६ गते रहेको छ ।
त्यसैगरी, गृहमन्त्रालयमा समेत विधानविपरीत भएको निर्वाचन परिणाम बदर गर्न माग गर्दै निवेदन दर्ता गरिएको छ । हेलो सरकारमा समेत महासंघको विधानविपरीत भएको महाधिवेशनका बारेमा उजुरी परेको छ ।
Kathmandu. A complaint has been filed with the Home Ministry alleging that the general convention of the National Federation of Nepal Transport Entrepreneurs held in Pokhara was against the law and statute. The seventh national convention of the federation was held from Baisakh 27 to 29 last year.
Vice-chair candidate Ramshashi Pandey, treasurer candidate Rajesh Kumar Shrestha, category coordinator (micro) candidate Kedar Sapkota and others have filed complaints with various bodies, including the Home Ministry, demanding the annulment of the election results, stopping the appointment, and action against the coordinator of the election committee, Krishna Prasad Gyawali, alleging that office bearers were elected contrary to the provisions of the statute despite their protest. The organization, registered under the National Director Act 2018, has filed the complaint with the Home Ministry.
They said that the candidacies of vice-president candidate Chandra Ojha, treasurer candidate Rajendra Acharya, and associate treasurer candidate Shobhakar Poudel were upheld even though they did not meet the qualifications.
Transport entrepreneur Rajesh Kumar Shrestha informed that the election was held on the basis of fake entrepreneurs and that he filed a complaint with the Ministry of Home Affairs after the election committee did not hear his claim even after he protested.
According to him, according to the information issued by the federation, the names of 1,473 people with voting rights were the same number when the election committee published the voter list on April 10, but on April 11, the names of 206 people were added and the election was held on April 12.
They allege that while three people, Tanka Prasad Basyal, Ganesh Shrestha and Gyan Bahadur Basnet, had already been nominated as central members as per Section 25 (a) of the statute, Shree Shrestha, Arun Shrestha, Deven Shrestha, Rajendra Acharya and Gokarna Prasad Parajuli, an expert advisor on freight, were nominated as central members at the last minute for the sake of leadership, contrary to the statute. According to them, the people nominated in this way, contrary to the statute, have also been made office bearers of the federation overnight.
The candidacy of another candidate for the post of general secretary, Ramesh Kumar Khadka, was withdrawn by the election committee after miking, saying that he did not meet the qualifications. They allege that different criteria were applied in terms of qualifications.
They have demanded that the election be annulled, the voter list of 1,473 people be investigated and maintained, the installation program of those deemed elected be stopped, and copies of the decisions of the Central Executive Committee meeting, which were nominated in violation of the statute, be retrieved from the Federation's office and investigated.
Former president of the federation, Bijay Bahadur Swar, has been accused of bringing Rajendra Acharya from Jaskela to the position of treasurer by making him a central member, contrary to the constitution.
It is alleged that, according to his own design, instead of nominating three central members as per the federation's constitution, eight were nominated and that he was made treasurer under the influence of Rajendra Acharya. Swar is also a central member of the Nepali Congress.
A case has also been registered in the Patan High Court, demanding that the election results be annulled, the installation program be stopped, and action be taken against the coordinator of the election committee, as the election of the federation is against the statute. The hearing of the case is scheduled for 26th Jestha.
Similarly, a petition has been registered with the Ministry of Home Affairs demanding the annulment of the election results, which were against the constitution. A complaint has also been filed with the Hello Government regarding the general convention of the federation, which was against the constitution.
